When you can sue designers?

 

If you have hired a professional to carry out design or architectural work on your property you are entitled to expect a good standard of service.

Unfortunately, it can be difficult to know which designers or architects are reliable, and even good designers and architects can make mistakes. If the work has not been carried out to specification or to a decent standard, your property may have been damaged or you may have suffered some other loss.

In this instance you may wish to sue the designers or architects who carried out the work.

Contractual failure

If the work has not been carried out to specification you may be able to sue the designers or architects under contract law.

The contract forms the basis of the professional relationship between you and the professional, and thus if they have failed to perform their contractual obligations you may be able to either terminate the contract or sue the designers or architects for damage arising out of their poor work.

Professional negligence

Alternatively, you may be able to sue the designers or architects under professional negligence law if they have failed to observe their duty of care to you.

Damage or loss must have resulted to you or your business as a result in order to be able to sue. For example, if the structure designed by the professional collapsed and caused injury, or if you were unable to use your business premises and lost income as a result, you may have a professional negligence action.
