When might an employee need a lawyer?

 

Everyone who works as an employee should do so under a contract of employment. Your employee contract can be written, spoken or even implied in some cases, but however it is laid out it is important to understand the terms and conditions you are working under to ensure your employer does not compromise them.

As an employee, your contract could be broken or compromised in a number of ways including: 

  • Health and safety legislation
  • Your rights when the business you work for is taken over or merged with another company
  • Discrimination including race, gender, sexual orientation or age
  • Your rights when being made redundant

The above is not an exhaustive list, as you may have particular circumstances that an employment solicitor can help you define in relation to current employment law. An employee lawyer will be able to help you clearly understand your grievance and whether this constitutes breaking employment law.

Compromise agreements

Often, you will be offered a compromise agreement to resolve the dispute you are in with your employer. These agreements are used to avoid an employment tribunal. Your employer will usually offer a sum of money in exchange for your complaint being dropped. You should always have any agreement you are offered checked by a lawyer with experience of employee law, as they can ensure your agreement is in your best interests.

Tribunals

If you do have to use an employment tribunal to settle your dispute, a solicitor is vitally important to ensure your rights as an employee are protected at every stage of your hearing. Never attempt to handle an employment tribunal alone. Employment law is complex and must be related to your particular circumstances as an employee of your company.
