What to do if you have a lift accident


Lift accidents are extremely rare today. Modern lifts have a range of safety measures in place including:

  • Multiple cables, each capable of supporting the lift alone
  • Safety breaks on each cable
  • Ratcheted shaft walls to catch falling cars
  • Heavy duty springs to reduce the blow on impact

Most accidents either take place in older lifts that are designed to be in continuous motion or in the case of the lift doors opening into an empty shaft.

How to claim compensation

In the unlikely event that you are hurt in a lift accident, you may well have a claim for compensation against the building owners. As with all personal injury claims, it must be started within three years of the accident.

Instructing a specialist personal injury solicitor will give you the best chance of a successful claim. They will take your statement and gather other evidence about what caused the accident.

They will also calculate how much compensation you are likely to be awarded by a court. This figure can be used to encourage the other side to settle the case. Very few personal injury claims actually come to trial – most settle early.

Calculating damages

How much you are awarded will depend firstly on how much you have quantifiably lost, for example by having to take time of work or meet medical and childcare bills. Secondly, on the degree of pain, suffering and loss of amenity you have experienced. This will be calculated by comparing your case to similar cases in the past and the compensation they were awarded.
