What is your lawyer's role?

A lawyer's role varies dramatically between legal systems in different jurisdictions. In England and Wales lawyers will act in their client’s best interests, except when they are unable to do so for ethical reasons.

A lawyer’s role at the very first meeting with their client is to take as much information as possible from the client, inform the client of costs and give as much advice as is possible at that stage. After the client leaves the offices, the lawyer’s role is to advance the case by obtaining evidence and liaising with the other side where appropriate. The lawyer’s role will vary between different areas of law and even on a case-by-case basis the duties of the lawyer will adjust significantly.

There are certain aspects of a lawyer’s role that will not vary and a lawyer must follow these rules from the very outset of the case. A lawyer has a duty to be aware of the possibility of money laundering occurring and must have systems in place to check for this. A lawyer also has a duty to protect client information and to keep it confidential; a lawyer also cannot take instructions where there is a conflict of interest or a risk of a conflict of interest arising. If a lawyer breaches any of the conduct rules that bind them then they risk being penalised by the Law Society and in the worst cases being struck off and forbidden from practising law in the future.
