What can a privacy lawyer advise me on?


Privacy lawyers practice a relatively new area of law. The European Convention on Human rights recognises a right to privacy but one has not previously explicitly existed in England and Wales.

However, certain specific laws, such as the Computer Misuse Act 1990 and the Data Protection Act 1998 have had the effect of protecting people’s privacy under certain circumstances.

Example situations

In recent years there have been some very high profile privacy-rights cases. For example, the wedding of celebrities Catherine Zeta Jones and Michael Douglas attracted a raft of litigation.

The Douglases brought a privacy action against a high-profile magazine after some of their unauthorised photographers gate-crashed the wedding. The legal battle that ensued provided landmark rulings on privacy-law rights.

This is obviously a high-profile celebrity case. There are many more circumstances which could be more applicable, such as safeguarding your right to family life, or confidentiality in employment. You can find out more about this in our privacy at work article.

Getting advice

If you believe your privacy has been invaded you should speak to a specialist solicitor. They will determine whether or not the law has been breached and whether it is worth pursuing a claim.

If the matter is domestic or has had little impact on your life, it may not be worth taking the case. On the other hand if your privacy was invaded by an employer or the press, it might be a more serious matter.
