Using property dispute solicitors


Land and property is one of the most complex branches of English law. Even an apparently simple dispute can drag on for years if it is not handled correctly.

Using a specialist property solicitor is always the best way to ensure that the matter is resolved as quickly as possible.

Negotiation and settlement

If you believe you have a case involving property, or if someone is bringing a case against you, instructing a solicitor early should be your first priority. They will take the details of your case, examine the evidence and advise you on its strength and how they think it should be resolved.

Most cases will conclude with a negotiated settlement, having never been to court. This is achieved by putting your case so clearly to the other side that they realise that their chances of winning are slim.

If done incorrectly, they may believe their case is stronger than it is and hold out in negotiations, hoping to win more after a trial. This should be avoided if at all possible. A good solicitor will do their best to reach a good resolution at the earliest possible stage.

Going to court

If your case comes to court, a solicitor’s job becomes even more vital. They will have to prepare your case to be presented to a judge.
This involves not only ensuring that your case is watertight, but highlighting the weaknesses of your opponent. They may well instruct a specialist barrister to assist with this stage.

Property solicitors can be expensive, but the earlier you instruct them, the shorter the case is likely to be and the less funding will be required.
