Unemployment and using a lawyer

Employee rights

As an employee in the UK, you have certain rights, which are protected by law. Employers’ obligations towards their employees are usually set out in contracts or agreements drafted for each new employee who joins the company.

While certain conditions – such as working hours, pay, entitlement to leave, etc – are easily understood, other entitlements for workers may be less clearly defined. Under the law, employees:

  • Have the right not to be discriminated against in the workplace
  • Cannot be dismissed without notice
  • Must have access to proper grievance or disciplinary procedures should any such disputes arise
  • Are legally entitled to financial compensation if they are made redundant

Forced to resign?

You may feel you were forced to resign because your employer breached (or intended to breach) your contract. In this type of unemployment, lawyers may suggest you have a case for constructive dismissal, which would be heard by an employment tribunal.

Being unemployed

If you’ve suffered unemployment, lawyers can also advise you on your rights as an unemployed person. In the UK, the state pays certain benefits to unemployed workers.

Being unemployed may give you access to certain other payments or subsidies. The government also pays national insurance contributions on your behalf. Benefits are not paid to an unemployed person if they are able - but unwilling - to work.
