Private individuals and the law


Private law concerns the law between individuals, and can be distinguished from public law which involves the state. In a free country such as the United Kingdom, the law is said to apply equally to all individuals and everyone is free to act as they please provided they do not contravene it.

Areas of law

Lawyers sub-divide the law into various fields, many of which may overlap and there is often no settled-upon definition.

For example, the broad field of ‘obligations’ may be divided into ‘contract law’ - that is agreements between people - and ‘torts law’ - that is obligations imposed by the state but enforced by individuals. Torts may then be divided into all sorts of areas such as defamation, nuisance, negligence and harassment. Each of these can be sub-divided even further!

Most of these fields are concerned with ensuring that individuals act in a predictable manner and ideally they will follow what most people consider to be fair in the long run. Even when unfairness is unavoidable, the certainty provided by the law allows people to plan for it.

Private client law

This is a specific area of legal practice concerned with matters that might be considered to be socially private. Many traditional solicitors have private client practices. They tend to deal with matters such as wills, probate, estates management, property, equity and trusts. They might also handle family and matrimonial matters.

These areas are often interrelated and it can be useful to have one solicitor or one firm who understands the connections between all of your different legal arrangements. This can help you avoid finding yourself in tangled legal disputes over technicalities.
