Solicitors' terms of business


If you instruct a solicitor to act for you they will normally issue you with solicitors’ terms of business which will outline the relationship between the parties. Solicitors’ terms of business will look at the responsibilities of both parties, and are used to ensure that everything that has been verbally agreed or communicated is put in writing. It is essential that both parties are clear on the matter involved, and solicitors’ terms of business ensure that the provision of legal services is clearly defined.

All solicitors are governed by the Law society, which was formed in 1823 to provide protection to solicitors and to ensure that those obtaining legal advice were being correctly represented. However, as well as having to abide by the rules of the Law Society, solicitors’ terms of business will also be in place. These are often extremely detailed, and will act as a contract outlining and guaranteeing an individual’s relationship with their solicitor.

For example, if you obtain legal advice you will, more often than not, have to sign up to a solicitors’ terms of business. Such terms may be wide and far-reaching, but will deal with topics such as cost, payment terms, service provided, liability, money laundering, data protection, confidentiality and insurance.

As well as protecting the solicitor, terms of business are also in place to ensure that the quality of service you receive is as you expected, and to make sure that you are charged according to what has been agreed. If you do not receive the level of service you perceive to be fair, the terms of business will give you an avenue to progress down.
