If you’ve had a skating accident, can you get compensation?

 

Skating in roller-skating and ice-skating rinks can be great fun, but skating accidents do occur and can result in very serious injuries. Should this happen to you, you may be able to claim compensation from the owner or operator of the rink.

Common skating accidents occur due to collisions with other skaters and falling and tripping due to hazards or unsafe surroundings. Common injuries sustained in skating accidents include broken bones and cuts, but serious bodily injury can also occur.

Starting your claim

As with all personal injury matters, you must bring your claim within three years of the accident; however, the sooner you can do so, the better.

In order to be successful, you need to prove not only that you were injured but that the owner or operator of the rink failed in their duty of care to you. For this you need evidence, which may become harder to gather as time passes.

You should instruct a solicitor at the earliest opportunity. They can take most of the work out of your hands - investigating your claim, gathering evidence, taking witness statements and calculating how much compensation you are entitled to.

Very often doing all this will be enough to settle the case without it coming to court.

Calculating damages

Compensation is referred to as ‘damages’, and there are two strands to it. Firstly, your special damages. These are any quantifiable financial losses you have incurred as a result of the accident. They might include loss of earnings, medical bills, travel and childcare.

Secondly, general damages. These compensate you for pain, suffering and loss of amenity. They are harder to quantify, since every case is different. Your solicitor will research similar cases in the past and use them to form an estimate of what a court might award.

Generally the worse your injury and the more it affects your lifestyle, the more compensation you can expect. For this reason, active people who can no longer participate in sports or athletic activities due to injury will usually receive more than those with a more sedentary lifestyle.
