Should you be compensated for an injury during birth?

 

Pregnancy and giving birth is supposed to be one of the greatest periods of time for any couple, and the trauma if there are any injuries at birth is excruciating and difficult to bear. This is particularly so if it is a birth injury which could have been avoided and was caused by a third party’s negligence.

What injuries are possible?

Birth injuries can occur as a result of entirely natural complications with delivery, but they can also be the result of medical inefficiencies or poor safety precautions to prevent contagious illnesses. Such problems can lead to harm to the mother or the baby and this can be very distressing.

Injuries to the mother can be anything from unnecessary vaginal tears to infections and for the baby can vary from umbilical cord complications to skin irritations, arm fractures and brain damage.

In extreme circumstances, due to the fragility of a baby, it can also lead to death. In certain situations doctors and nurses can be held accountable for acts of negligence and any financial payout will be made by the hospital’s insurance company.

Professional negligence

Such medical negligence comes under the category of 'professional negligence' as doctors have a duty of care towards their patients. This means that they are responsible for carrying out procedures with due diligence and in the proper manner, to the best of their ability.
