Seat belts and accidents


Seat belts undoubtedly save lives. They also reduce the occurrence and severity of injuries received in car accidents. Consequently, for over 20 years now, UK law has imposed responsibility on drivers and passengers to wear seat belts. The rules apply to all vehicles where seat belts are fitted, including vans and other goods vehicles, buses, minibuses and coaches. Particular rules apply for children, pregnant women, disabled persons; and exceptions may be available for medical reasons.

UK law requires that, if fitted and available, drivers and passengers aged 14 and over must wear a seat belt. Accidents in which passengers are not wearing seat belts result in far more serious injuries than when the passenger is wearing a seat belt. Accidents can also be caused when children not wearing a seatbelt distract the driver.

It is the responsibility of the driver to ensure that anyone under the age of 14 is either in an appropriate child restraint or wearing a seat belt. Accidents that occur in which you have not carried out this obligation could lead to liability for the injuries sustained by the passenger, and you could be personally liable for prosecution. You can even be responsible for paying compensation to your own child.

If you are involved in a car accident and you are not wearing a seatbelt then your compensation may be reduced as a result.
