Right to Compensation for riot victims

If you are a property or business owner and have suffered damage due to rioting, you may be able entitled to compensation.

Even if you do not have the appropriate insurance cover, there are statutory protections in place to cover losses sustained because of the recent public disorder.

Riot Damages Act 1886

Following the riots that took place in the summer of 2011, Prime Minister David Cameron confirmed that compensation is available from the government under the Riot Damages Act 1886. Under the Act, individuals can make a claim for losses when property or contents are damaged, destroyed or stolen during rioting.

Although the initial deadline for such claims to be made is usually within 14 days of the incident occurring, the Prime Minster has agreed to an extension of 42 days for lodging a claim following that specific incident.

In the future, however, it is imperative you seek legal advice and initiate your claim as soon as possible.

Application process

The application procedure can be started by individuals on their own; however, solicitors who are experienced with making claims through the Act and other related legislation can assist victims throughout the process, maximising chances of a successful application.

It can be a lengthy process; many people are currently still awaiting compensation for the 2011 riots, but having representation makes it much easier to press your claim.

The Act however, does not cover personal injury. If you have suffered injury, the possibility of compensation is available through CICA (Criminal Injuries Compensation Authority). This is a government organisation, which provides compensation to innocent victims of crime.
