Property purchase


In order to participate in property purchase in England and Wales, there are many procedures that must be adhered to. Many of these are in order to ensure that, simply put, you buy what you think you are buying.

A solicitor can assist you with your property purchase and will carry out all relevant searches and enquiries to make certain there are no defects or problems with the property, or at least that you are aware of any problems.

Things to look out for when purchasing a property

In property law the principle of ‘caveat emptor’ applies. This is a legal term which literally translates as ‘buyer beware’. The effect of the principle is that if a seller is selling a property and knows of defects in the property, it is not up to them to disclose them; it is up to the buyer to discover them.

What this means is that when you purchase property, it is your responsibility to find out problems with that property and any failure to do so means that you bear any financial loss.

What your solicitor will be responsible for

By instructing a solicitor to assist with your property purchase, you remove the risk of unexpected financial loss as a result of not doing the required investigation. Your solicitor will be responsible for undertaking the required searches and asking various parties the right questions. If your solicitor fails to do something that they should have done, they may be liable in negligence and any financial loss you suffer as a result can be claimed back from your solicitor.
