Online divorce


A number of websites offer ‘online’ divorces, usually for a fixed fee. This may seem like a cost-effective alternative to a solicitor but it is important to bear in mind the potential pitfalls.

Online divorce explained

An online divorce typically involves a downloadable kit to assist you to prepare the documents for your divorce petition.

The process is not foolproof, and without the presence of a solicitor it is easy for small mistakes to creep through. The court might refuse your divorce petition on a technicality, resulting in wasted time and money.

In addition to the divorce petition itself you might need to resolve other legal issues, notably:

  • Child custody
  • Financial separation

These are too complex to be covered by generic legal documents and information. A solicitor can advise you on these matters based on your particular circumstances. They will also bring to your attention legal implications of your divorce that you may not be aware of like:

  • Taxation
  • Inheritance issues

Poor regulation

There is little regulation of online divorce businesses and no specific body to complain to if things go wrong. In the case of a solicitor you can be sure that you are dealing with a qualified professional who is subject to Law Society rules on their competence and conduct.

Do-it-yourself kits may be tempting as they are inexpensive and seem to set out a step-by-step process of how to get divorced, but they are no substitute for the sound guidance and legal support you can get from a solicitor from the start to the finish of a divorce.

Remember, a fee for a kit does not include court fees, which you will have to pay for. Divorce kits may be fine to use if you and your spouse have agreed on:
