What is media and entertainment law?

The purpose of much media and entertainment law has been created with an intention of safeguarding the public. For example, broadcasting and advertising are subject to certain codes which reflect decency and allow the public to voice concerns that such standards are not being met.

Media and entertainment law is developing rapidly as it is especially affected by technological advances, the internet being a platform which generates many legal problems. Any web content created even by an anonymous user:

  • Could be offensive so as to defame someone
  • Could be copied so as to infringe another's copyrights
  • Could even be an exposing photograph which invades privacy

Not only is this causing much debate in the press but it constantly transforms the rules and regulations set out by media and entertainment law.

It is clear that many of us are or will be affected by media and entertainment law in some form or another. Due to the evolving nature of this type of law it would be wise to seek a specialist solicitor who can explain how to protect yourself from litigation as well as assisting you on any case brought against you.

What types of issues fall within media and entertainment law?

As the world of entertainment covers so many different disciplines, entertainment law has had to diversify to take into consideration a number of different laws and regulations. Often called media law, entertainment law has intellectual property law at its foundation. Anyone who creates a ‘work’ such as a book, painting or any other creative work must understand how copyright law protects them.

However, entertainment law also includes other areas of legislation as well, such as:

  • Employment law
  • Tax law
  • Immigration law
  • Contract law

You may find that your work in the entertainment industry touches on many different aspects of the law. This is why there are specialist lawyers that deal exclusively with the parts of the law that impact on the entertainment and media industries. If you are in any doubt about your legal standing, always contact a solicitor before taking any action.

Because ‘entertainment’ can encompass so many different areas of the media - from publishing to the theatre - a professional should always handle the many aspects of the law which form the legislation that governs these creative industries. Specialist entertainment solicitors exist and can give you all the help you need with whatever case you want to bring.

Never attempt to interpret entertainment law yourself. A qualified solicitor will be able to help, support and represent you.
