Litigation firms


A litigation firm is a law firm which specialises in litigation. Although nearly all firms have a litigation department, only a relatively small number of firms would label themselves as an outright litigation firm.

When a firm does in fact market itself as such, it is likely to focus on a specific type of litigation, such as injury, commercial or intellectual property, rather than simply ‘litigation’.

What kind of litigator do I need?

This sub-specialisation is the result of the vast differences between the litigation procedures in different areas of law. The skill-set a commercial litigator must possess includes:

  • An excellent knowledge of commercial law
  • An understanding of commercial concepts

Intellectual property or patent litigators sometimes require a science background, whilst injury litigators need to have a very good grasp of medical conditions. 

A litigation firm may have several areas of expertise. For example, an injury litigation firm may specialise in:

  • Road accidents
  • Work-related injuries
  • Medical negligence

However, commercial litigation firms are much more likely to expand their commercial speciality rather than their litigation focus. Therefore a commercial firm would offer other commercial services, such as:

  • Company registration
  • Merger and acquisition advice

Why use a solicitor in court?

Solicitors that appear in court are all fully trained and should be members of the Law Society of England and Wales. You should always check the credentials of any solicitor before you formally hire them to handle your court case, or to perform any other duties for you. In Scotland, solicitors in court are regulated by the Law Society of Scotland.

There is also a corresponding society for solicitors working in Northern Ireland.

Using solicitors in your court case is now much more efficient than it once was. The Law Society can give help and advice about the duties that a solicitor can perform for you. Solicitors in court often have skills and knowledge in specific areas of the law. Always try and locate a solicitor to help you that has previously handled your type of case.

Solicitors in court can be helpful as they can speak for you and also have a better understanding of court proceedings. If you are a defendant in court, a solicitor is essential. Never try and represent yourself in court. Solicitors in court can be expensive, but in some cases you can get help with their costs in the form of legal aid.
