International criminal law

International criminal law gives criminal culpability to individuals in breach of international laws. Many of the individuals prosecuted are accused of being involved in war crimes and crimes against humanity.

If you are dealing with an international criminal law matter and require representation, call us and we can recommend a specialist international criminal lawyer to assist you.

The International Criminal Court (ICC)

The International Criminal Court (ICC) is the main court involved in the prosecution of people with international criminal liability, although there are other tribunals largely for the prosecution of people involved in genocides in particular places, such as:

  • The International Criminal Tribunal for Rwanda
  • The Courts based in Cambodia (for the trial of crimes committed during the Khmer Rouge regime)

The ICC is based on a treaty that has been signed by 110 countries across the world. As such, the ICC is the highest international criminal court in the world. The court is based in The Hague, the Netherlands.

The purpose of the ICC

The ICC was established to help end impunity for perpetrators of the most serious crimes which are of concern to the international community.

In most cases criminal international law will be handled by each country’s own judicial system. International criminal law often extends over national borders, but usually in these cases the ICC still wouldn’t become involved, as the ICC is only concerned with the most serious international criminal offences.

The court is a last resort for persons in breach of international criminal law and the ICC will only act if there has been no prosecution by national courts, or only a sham prosecution. In addition, the ICC will only try people accused of the gravest crimes such as:

  • Genocide
  • Crimes against humanity
  • War crimes

The prosecutor can initiate investigation on the basis of a referral from a state or from the United Nations Security Council. The prosecutor can also investigate on the basis of information on crimes within the jurisdiction of the court.

In all cases criminal international law will require the support of legal counsel. It is possible to represent yourself even at the ICC, but most cases will be supported with legal representatives including solicitors and barristers.

If you are accused under international criminal law, you must get legal representation as soon as possible. International criminal law is highly complex as it can include many country’s judicial systems that all have subtle differences. Your legal team should have detailed knowledge of the international criminal law you have been accused of breaking.

Their support and help will give your case the best chance of a successful outcome.
