What is illegal immigration?

Illegal immigration occurs when people are in the UK in breach of immigration laws.

What happens to people who are in the UK illegally?

Under immigration law, illegal immigrants can be removed from the UK by a process known an ‘administrative removal’.

The following people can be removed from the UK under this process:

  • Those who have failed to observe conditions attached to their leave
  • Those who have stayed in the UK longer than their leave permits (commonly referred to as ‘overstayers’)
  • Those who have obtained leave by deception
  • Illegal entrants

What if you have been detained?

If you have been detained as an illegal immigrant, and/or threatened with deportation, you will need to get urgent legal advice from an immigration lawyer.

How is it decided whether an illegal immigrant will be removed from the UK?

When deciding whether to remove someone from the UK, the following factors will be considered:

  • Their age
  • Length of residence in the UK
  • Strength of connections to the UK
  • Personal history
  • Domestic circumstances
  • Previous criminal record
  • Compassionate circumstances
  • Any other representations made on the person’s behalf
