How to use a finance lawyer

Using a finance lawyer for bankruptcy matters

You could, for example, petition for bankruptcy. Financial lawyers could help you make such a petition. You may be able to petition for bankruptcy if you can show that you are unable to pay your debts as they fall due.

There are some benefits of making a bankruptcy petition. For example:

  • As soon you petition for your own bankruptcy, the court can stay any current actions against you. This means that those whom you owe money to (known as ‘creditors’) cannot take any legal action against you to enforce the debt
  • Once bankruptcy proceedings have finished, you will be allowed to start again debt free

Alternatively, financial lawyers could help you draft and negotiate individual voluntary arrangements (‘IVAs’). IVAs involve you, with the help of lawyers, reaching a compromise with your creditors. This may enable you to settle your debts and may allow you more time to pay.

Authorisation

Anyone that gives financial advice must be authorised by the FSA (Financial Service Authority). They ensure that all the current rules and regulations are followed with regard to finance law.

As finance has many different elements you may find it advantageous to use a lawyer with specialised knowledge and skills.
