How to use a dispute solicitor

If you are in dispute with your employer, the first thing you must do is write to your employer setting out the details of your dispute. A dispute lawyer can help you draft this letter if you feel you can’t do this yourself.

If you cannot find a mutually agreeable solution, the only course of action left open to you will be an employment tribunal. An employment tribunal is not a court of law, but uses many of the conventions that a court of law has.

The tribunal hearing

Your hearing will be in front of three people, called the ‘tribunal’, and it will include an employment judge.

If you do use an employment tribunal, there is no charge for using the services other than any additional costs you may have to meet if you use the services of a dispute solicitor.

Note: you will give evidence under oath and if you lie, you could be charged with perjury, a very serious offence. Also, if you are in Northern Ireland, there are some differences to how employment tribunals work. Your dispute solicitor will be able to explain these to you.

As you will be challenging your employer on what could be points of employment law, it is vitally important to have a dispute solicitor represent you. Employment law can be highly complex and even more so if you are claiming discrimination of some kind.

Your dispute solicitor will be able to advise you about whether an employment tribunal can actually hear your case.

You must make your application for an employment tribunal within three months of the event you are making a claim about. If you have any initial questions about employment tribunals, you can contact the general enquiry line for the Tribunals Service on: 0845 795 9775.

A dispute solicitor can be an invaluable asset to have available. From your initial grievance to representation at an actual employment tribunal, a dispute solicitor can help and support you at every step of your case.
