Hip injury compensation claims


Hip injuries are often associated with the elderly but, whilst those over 60 are especially at risk, they can occur to anyone. Depending on the severity of the damage, they can be extremely debilitating and require extensive ongoing treatment causing drastic changes to a person’s quality of life.

Causes and impact of hip injuries

Most injuries to the hip are caused by impact, either as part of a fall or often in a car accident. The damage can vary from a painful fracture to dislocation or even crushing.

In some cases, particularly with elderly patients whose bones are more fragile, replacing the hip bone with a prosthetic may become necessary. This is a serious operation and will require a prolonged hospital stay.

Rehabilitating a hip injury can be a lengthy process. After a long period of inactivity muscles will be weaker and physiotherapy may be required to rejuvenate them. If the injury was serious, mobility may be permanently impaired and frequent exertion such as driving may result in chronic pain. For some people tis will be life changing.

If the hip injury was partially or wholly the fault of another party, there may be a viable claim for compensation. It is not always obvious what the cause of an injury was and specialist advice should always be sought.

For example, a patient might think that they hurt themselves through their own fault, but it may emerge on examination that proper health and safety procedures were not followed.

Compensation is awarded in two categories known as special and general damages.

The first of these is calculated as the amount of money the patient has directly lost as a result of their injury, for example in time off work or transport costs. The second is the amount awarded to compensate for their pain, suffering and loss of amenity. The greater the impact the injury has on their life, the more compensation will be due.
