Handling a workplace settlement

 

If one of your employees feels they have not been treated within the terms of their employment contract, they can use a tribunal to have their case heard by a court. A tribunal court is a judicial body, but it does not have many of the formal systems that civil courts will use.

The employment-tribunal court will award any commercial settlement that your business has to pay.

It is always better to attempt to settle any disputes you have with employees internally, as a commercial settlement can be expensive and damaging to your business overall. The workplace settlement you may have to pay can include costs of around:

  • £66,200 for unfair dismissal
  • £25,000 for breach of contract
  • £18,200 for failing to reinstate an employee

How will the amount be decided?

The employment tribunal will decide on the workplace settlement payment you will have to make to your employee if the court finds that your business has broken employment law.

Importantly, in cases of discrimination there is no limit to the amount of the commercial settlement that can be awarded in these cases.

Using representation

As employment tribunals can be very serious - especially where claims of discrimination are concerned - you should at all times have qualified legal representation. Employment law is complex. Using the services of a solicitor that has experience of employment law will ensure any commercial settlement you do have to pay is fair.

Never attempt to fight an employment-tribunal case without legal support. Employment tribunals are courts of law and should be treated as such. Your employment law solicitor will be able to give guidance and speak for your business’s best interest.

They can also interpret the employment law as it currently stands and minimise any commercial settlement you are ordered to pay.
