Five FAQs about arbitration and employment


What is arbitration?

Often used in disputes between companies, arbitration is a form of ADR (Alternative Dispute Resolution) that uses independent third parties to help find a solution to the disagreement. As some disputes can have a serious legal aspect, it is always advisable to obtain the advice and guidance of a specialist solicitor.

Arbitration is also commonly used for employment disputes between employers and employees.

Are the decisions reached with an arbitrator legally binding?

Before arbitration begins all parties to the dispute are asked to agree that they will be legally bound by the arbitrator’s decision. You do not have to do this, but if you do not, your dispute could become protracted. If this is an employment case your solicitor can advise you whether you should agree to be legally bound to the decisions made.

Can I still use an employment tribunal?

After your arbitration has concluded, if you still feel that no resolution has been reached, and you did not agree to be legally bound by the arbitrator’s decision, you could still use an employment tribunal. Employment law solicitors can provide support and representation if you decide to use this service.

What about Acas?

As one of the best-known employment arbitration services, Acas can provide trained arbitrators to help resolve your dispute. Generally, the decisions of Acas appointed arbitrators would be legally binding, but you do have the option of refusing this before arbitration begins. Consult with your solicitors to ensure you make the right decision to protect your interests.

Why should I always have a solicitor advising me?

Depending on the reasons behind your dispute, an employment law solicitor can provide invaluable help and advice.
