Employment law in Birmingham


Employment law is a complex and frequently changing area of law. A prime example of how common law operates can be seen in a recent Employment Appeal Tribunal case about a dispute in Birmingham. In the case of Mason v The Governing Body of Ward End Primary School the appeal tribunal further defined the rules regarding unfair dismissal. However sometimes further procedures are agreed upon between the parties, and described in an employment contract.

If the circumstances of a dismissal fell between these boundaries, that is, failed to follow the contractually specified procedures, but was compliant with statutory requirements, it was unclear if it would be considered fair. This case clarified the law in such cases, stating that an employer is excused from failing to comply with the more detailed contractually specified procedures, but not from its duty to act reasonably in all the circumstances and to comply with Acas standards.
