Information for employers

There are many situations in which one would require the professional advice of a lawyer. Employers usually require a legal professional to ensure they are in compliance with the vast rules and regulations attached to employment.

Under English law the responsibilities of the employer can be overwhelming, especially to some small businesses. Call us if you are an employer and require employment advice on the general running of your business, or if you need defence in a claim against you by an ex-employee.

Employer considerations

It is common for an employment solicitor to be associated with helping an individual to bring a claim against his or her employer.

Solicitors who specialise in employment matters often represent these clients on a one-off basis, as an individual rarely requires employment advice on more than one occasion. However this is not the case when solicitors represent employers.

The legal considerations related to employment are both varied and complex. Every aspect of employment is governed by the legal framework known as employment law, from:

  • The hiring process
  • The firing process
  • Retirement and pension plans

This can make running a business very difficult for an employer. You need clear and comprehensive advice regarding the different aspects of employment law, and you will need help in the resolution of employment disputes.

Employer protection

By seeking advice from an employment lawyer, employers can ensure that their activities are in compliance with relevant legislation. Employers are therefore able to reduce their exposure to lawsuits. For example:

  • An employee that is injured on the job will only be entitled to compensation if the work environment was unsafe
  • By ensuring that health and safety policies and risk assessment procedures are approved by a specialist lawyer, employers effectively reduce the chances that injury will occur, and that the business will suffer a financial loss in court if it does

As you may know, the consequences of not complying with legislation can be severe. Not only can a fine be levied against a non-conforming employer, but if an injury occurs the employer himself might be held liable, rather than the insurance company.

This is because it is a common term in an employer’s liability insurance that if the insured (i.e. the employer) is in violation of the law the insurance may not be valid.

If you are an employer you are more than likely familiar with certain regulations regarding your responsibilities. It is still advisable that you check with a solicitor from time to time to ensure that the standards have not changed and that you are still compliant.

If you are an employee searching for legal advice, see our page on when to use an employee solicitor.
