Divorce mediation

Using divorce mediation services can help your divorce process by giving you and your spouse a neutral and confidential forum to talk through the issues to do with finances, property and arrangements for your children following a divorce.

How does mediation work?

Mediation is a series of meetings in which you and your spouse come together to discuss issues face-to-face. A mediator will sit in the meetings with you, acting as an impartial third party.

They will promote agreement by guiding the two parties through the resolution process, ensuring that you and your spouse discuss the issues that matter and leave any aggression at the door.

Mediators are:

  • Trained by the National Family Mediation service or a similar body
  • Recognised by the Legal Services Commission

It is because of this specialist training that mediators are able to skilfully draw out the important matters and use the information given in the meetings to present various options which the two parties may use as a basis of agreement.

No legal advice

However, although divorce mediation services can provide options and a ‘safe’ arena for discussion, the mediator involved cannot tell either party what they should do.

A mediator is not a substitute for a divorce solicitor, who can provide you with the proper legal advice and can explain the procedure you must follow in order to obtain a legal divorce. Mediators and solicitors can however work hand in hand.

The role of a solicitor during divorce mediation is:

To ensure that the arrangements you agree to are workable from a legal perspective

  • To make you aware of the full legal implications of your agreement
  • To create a clear written record that takes into account potential changes to your circumstances, and is legally binding

Solicitors are skilled in drafting written documents and will help you minimise the possibility of future disagreements by having a clearly recorded agreement.

In order to make your child maintenance and financial separation agreement legally binding, a solicitor can obtain a court order known as a consent order on your behalf. This will give you peace of mind that matters are finalised and your former partner will not break your agreement.
