CRB problems - do you need help?

 
Launched in 2002, the Criminal Records Bureau (CRB) is an agency of the Home Office. It provides criminal records information regarding potential employees in order to identify people who may be unsuitable to work with children or vulnerable adults.
 
Prior to the CRB’s introduction organisations outside the public sector had little or no access to police checks despite employing staff with access to vulnerable groups.
 
If you are applying for a job that involves working with children or vulnerable adults your prospective employer is obliged to carry out a CRB check.
 

Can it go wrong?

The CRB provides a necessary service, however it isn’t perfect and issues can arise when unproven allegations appear on a CRB report.
 
For example, an Enhanced Disclosure involves an extra check with the police which may show ongoing investigations, or those which did not lead to a criminal conviction. This may result in a person who was falsely accused of a crime being unsuccessful in a job application, for instance.
 
Police Cautions and spent convictions can also appear on a Standard Disclosure CRB check, which releases the details of any convictions, cautions, reprimands or final warnings.
 

Is there anything that can be done about it?

There are solutions to a lot of CRB problems and specialist companies who can assist achieving them.
 
Applications to remove convictions can only be made if they have previously been “stepped down”. The only other exception is a recent change in which gay men who were convicted of underage sex before the age of consent was reduced to 16 years old can apply for those convictions to be disregarded.
 
Cautions can also be removed from a CRB check, but it is at the discretion of the police. One way of achieving this is by proving that police procedures weren’t correctly followed.
 
Due to its nature, the information that appears in Enhanced Disclosures has a much greater chance of removal.
