Conveyancing questions

Buying or selling properties can be a stressful event for anyone. The work involved in the land transfer is complex and burdensome; however, this can be relieved by instructing a specialist property solicitor to assist you on all the legal aspects of the sale, known as conveyancing.

This includes conducting searches, liaising with mortgage lenders and drawing up contracts.

Can you do the conveyancing work yourself?

Although most people will find a legal adviser to assist them on all their conveyancing questions and problems, there are some who wish to fulfil the legal aspect themselves. This is a bold move for those with no prior conveyancing experience as the smallest mistake can have catastrophic results such as the collapse of the sale.

For this reason it is common, and advisable, to instruct a proper conveyancer or property solicitor.

Specialist areas of conveyancing

The typical aspects of a sale which may raise conveyancing questions usually concern finance and risks. Here is some information that may help along the way.

  • Conveyancers can act for both a buyer and their mortgage lender, provided the mortgage lender is a standard bank or building society
  • The conveyancer will never usually act for both the buyer and seller of one property or for a buyer and any other type of mortgage lender
  • If the other party pulls out of the sale before contracts are exchanged, nothing can be done. You will not be entitled to compensation; however, this does depend somewhat on specific circumstances and so only a legal practitioner who understands your situation can answer this question properly

Finding a conveyancing solicitor

Conveyancers can come in a variety of forms, from the solicitor in general practice who also works in property to a licensed conveyancer who has undergone special training from the Council of Licensed Conveyancers. Both will have the requisite legal knowledge to answer any of your conveyancing questions and will be able to advise you wisely.

There are myriad conveyancing questions that you may need to ask when beginning or even considering the process of a property transaction. Conveyancers and property lawyers are best placed to answer these queries so it is advisable to consult a lawyer before you begin a sale. Whether you need advice on a purchase or sale, conveyancing solicitors are essential.
