Conveyancing refers to the legal and procedural aspects of a property transaction and is usually undertaken by a specialist conveyancer or property solicitor. So, what are sometimes referred to as conveyancing companies are actually legal practices or specialist conveyancing firms.

How do I choose a conveyancer?

Finding conveyancing companies can seem like a daunting task as there are many around. Some estate agents will also recommend a certain conveyancer themselves, but this may not be the most economical offer around as the agent may take a personal commission.

Here is some basic information on conveyancing that could aid your search.

There are a few different types of conveyancer who will be able to assist you, so knowing what type you’re after could benefit your search for conveyancing companies.

  • There are licensed conveyancers who have passed exams and taken extra training set by the Council of Licensed Conveyancers, and they may charge more for their specialist expertise. Although incredibly helpful for any conveyancing task, these professionals often deal with complex conveyances such as large, historic or non-residential properties
  • A solicitor in general practice who also specialises in property law can usually offer equally good advice on regular property transactions

What work does the conveyancer do?

It is also helpful to have an idea of the type of work a conveyancer will undertake when approaching conveyancing companies. A conveyancer will be your port of call for all legal elements of the transaction, including:

  • Surveying the property
  • Conducting local authority searches (such as drainage and water)
  • Inspecting the title deeds
  • Dealing with a mortgage lender

They are responsible for drafting, negotiating and exchanging contracts with the other side and so their legal experience and knowledge is particularly necessary for this stage.

Typically, buyers and sellers will instruct a conveyancing company for the whole length of the property transaction, so their involvement will depend heavily on how well the sale progresses.

Therefore it is preferable to instruct a conveyancing company who adopt very open and frank client treatment so that you communicate at every step of the way.
