Compensation for a hamstring injury


The hamstrings are the group of muscles and tendons at the back of the thigh and run from the bottom of the pelvis to the lower leg, just below the knee. They are used to extend the hip and bend the knees, allowing us to walk and run.

Although capable of taking a lot of strain, hamstring injuries are common, especially amongst athletes. They occur when the muscles are stretched too far, usually causing a strain but, in the worst case scenarios, the muscles or tendons can tear.

Impact of a hamstring injury

Hamstring injuries require rest in to order to recover. Minor muscle pulls can take up to four weeks to heal, and severe tears can take up to six months to fully repair. If you lead an active lifestyle you may find it severely curtailed. You may require the use of crutches and your mobility will be severely reduced.

This may be a serious problem if your profession requires you to be on your feet for much of the time. If you are a construction worker, a teacher or a medical professional, you may find that you are not able to perform your job as well as you used to. Nonetheless, is important that you take the time to recover; trying to do more than you are capable of my make the injury worse.


Whether you are entitled to compensation will depend on how you came by the injury. If it was in the course of a sport where you were aware of the risks then it may be difficult to claim any award for damages. However, if the injury was down to poor training, lack of supervision or poorly maintained equipment, there may well be a case.

Personal injury claims are there to compensate you for your loss. This takes two forms:

  • Special damages: These are the objectively quantifiable losses, most commonly lost wages due to time off work
  • General damages: These are to compensate you for your pain, suffering and loss of amenity. The more painful your injury, and the more it impacts on your life, the more you will be able to claim

Your damages may also be reduced if you are found to have partially caused the injury yourself. For example, if the instructions from your trainer were accurate but not clear, you may still be partially responsible if you do not follow them because you could have asked for clarification.
