Common injuries

Common injuries resulting from these accidents are:

Accidents such as these qualify for personal injury compensation provided they have been caused by another person's negligence. If you have been involved in an accident then you could bring a claim for damages provided that you begin proceedings within three years of the incident.

How do I know if I have a case?

The law of tort will govern any compensation claim you make for a common accident or injury. In essence, tort seeks to attach a monetary value to something a person has lost or suffered. In some tort cases such as burglary, this allocation of loss is relatively straightforward as a value can be attached to the items you have lost.

However, with a common injury, the tort law has to consider a number of factors such as how your injury has impacted on your life before assigning a value that can be paid in compensation.

To give your case the best chance of securing the compensation you are looking for, you have to prove negligence has taken place, and that directly resulted in your injury. Your solicitor will need as much documentary evidence as you can provide to give them the best chance of winning your case.

Most common-injury cases never actually appear before a court. Most claims for a common injury are settled out of court to avoid the time and cost of a court hearing. Your solicitor can not only help and support you throughout your case - they can represent you in the negotiations for an out of court settlement.

How much compensation can I claim?

Accidents such as the ones named above can be very difficult for the victim and their family, and as such require varying types of calculations. Damages can be calculated quite easily in some circumstances; for example, with property damage it is quite simply the value of the property that has been damaged and other expenses which are a result of the accident.

Another example of where compensation is easy to calculate is wage loss, although this can become include more complicated considerations, such as:

  • Future benefits
  • Bonuses
  • Raises

Damages for other common accidents are slightly more complicated. This may be because the claim is for something which is hard to quantify, such as 'pain and suffering'. It may also be difficult to determine the amount of compensation for a particular claim because there are often many factors to be considered.

If the claim is settled out of court then the compensation calculations are generally negotiated and agreed upon by the personal injury solicitors from both sides. However, if the claim proceeds to court, then it is determined by the judge.
