Claims for knee injuries

Knee injuries

Knee injuries are a common problem for athletes and dancers due to the amount of physical pressure they exert on their knees. Unfortunately, knee injuries can also occur as the result of an accident. Knee injuries can vary in severity, and can be temporary or life-long injuries.

Common accidents resulting in knee injuries include:

  • Cycling accidents
  • Slips, trips or falls
  • Car accidents

Knee injuries can be the result of the ligaments and the tendons in the knee being overstretched. The cartilage in the knee is also susceptible to damage in an accident. The bone in the knee, which is called the patella, can fracture upon impact with a hard surface. Many knee injuries require surgery and almost all will involve some form of rehabilitation, for example physiotherapy.

Compensation can be awarded for knee injuries if they were the result of an accident, and the accident was caused by another party. In order to receive compensation for a knee injury, a personal-injury claim must be submitted to the party at fault.

It is highly recommended that a solicitor specialising in personal-injury claims makes a compensation claim on behalf of an injured party. They will be able to accurately assess the amount of compensation that is appropriate, and pursue the claim to court if necessary.

Making a claim

It is worth bearing in mind that few personal injury cases actually reach court - most settle out of court as:

  • It saves costs and publicity for the defendant
  • It saves costs and time for the claimant

The sum you receive in settlement of your claim will be based on the amount of damages that you would be likely to receive in court. It is therefore important that a solicitor is able to properly work out the damages you should receive and negotiate around this figure with the defendant.

Damages can be worked out by considering the actual financial loss of the claimant in the past and in the future. This involves loss of earnings and additional outlay as a result of the injury. The judge will also consider the claimant’s pain and suffering and loss of amenity.

This is a partly subjective exercise and in the case of knee injuries the judge will consider:

  • The claimant’s activities before the injury
  • Past case law

The award for the pain and suffering for knee injuries can be up to £52,500. Obviously it depends enormously on the extent of the injury – one which has not resulted in much loss of earnings will not attract much in the way of an award. Medical bills and proof of treatment will be required.

If you have been in an accident and suffered a knee injury as a result, you may be entitled to claim compensation if the accident was not your fault. The compensation you may be entitled to can include any financial costs incurred by the accident, for example the loss of wages or damage to your property. In some cases, compensation may be awarded for the pain and suffering caused by an accident. A personal-injury solicitor’s opinion is highly recommended in the event of a knee injury accident claim.
