Can I claim for leg injury?

 

If you have suffered a leg injury as a result of an accident that wasn’t your fault, then you may be entitled to compensation through a personal injury claim. Your success will depend on multiple factors and you should always be careful to follow the proper process.

Getting the claim started

As soon as possible following the accident, you should instruct a personal injury solicitor to assist you in compiling the information and evidence you need to make your claim. A solicitor can help to gather evidence on whose fault the leg injury was and evidence on how much compensation you should receive.

Try to make sure you collect and keep as much evidence yourself as possible. Take photographs of the area where the injury occurred and of any visible wounds. Save any correspondence you have regarding the accident, this includes informal emails and texts.

They can be vitally important to deciding who is at fault. Your solicitor will review them and might discover they can be used as an admission by the other side.

Compensation calculation

In a personal injury claim, once your solicitor has decided who was at fault in your case, they will determine how much compensation a court would be likely to award. Doing this accurately greatly increases the chances of the case never coming to court, since the other side is likely to agree to settle.

Compensation is designed to return you to the position you were in before the accident. It is calculated in two parts.

Firstly, the ‘Special Damages’. These refer to the amount of money or property you have quantifiably lost due to your injury. If you were not able to go to work for some time or even lost your job, then you will be paid the money you would otherwise had made.

Similarly if you have had to pay for medical bills or childcare during your recovery, these will be covered.

Secondly, the ‘General Damages’. These seek to compensate you for your pain, suffering and loss of amenity. They are where they type of injury you have suffered becomes most relevant.

For example, if you play a lot of sport – even recreationally – the loss of the use of your leg will be more serious to you than for someone who spends most of their time sitting down.

Similarly, if the injury to your leg completely heals, you will receive less than if your leg is permanently damaged or amputated. Which leg you hurt is also relevant, although less so than for hand or arm injuries.
