Claims for a joint injury


If you suffer a joint injury as the result of an accident that wasn’t your fault, then you may be entitled to make a personal injury claim.

Making a claim

Injuries to joints have many causes, some of which are not immediately obvious to non-specialists. Your solicitor will take the details of how your injury was caused and determine who the liable party is, if there is one.

For example, if you hurt your knee whilst at the gym, the solicitor will take a view as to whether it was due to the gym’s negligence or an accident you brought on yourself. Even if you think the injury was your fault, that might turn out not to be the case.

Getting the case right first time is important. If you can present a strong claim you are far more likely to get a quick result. The vast majority of personal injury cases never come to court and are often settled early.

What to expect

Damages for a joint injury will not be the same with every claimant. They are calculated based on how much your quantifiable losses are, that is, how much money you have lost or will lose due to your injury, and also your pain, suffering and loss of amenity.

The latter is calculated based on case law and your solicitor will compare your case to similar cases in the past.

Your compensation will be more depending on the severity of your injury and how much it affects your life. An active person will therefore get more than someone who does not enjoy exercise.

The importance of the joint itself will also be taken into account. You should not expect as much for hurting a knuckle on your left hand’s little finger as for permanently damaging your right knee. Unless, of course, you are a professional piano player.
