Claiming for bad accidents


Sports injuries, slips and trips at work, falls at home, road traffic incidents, clinical negligence and industrial diseases are all examples of bad accidents. Should you be unlucky enough to be involved in any of these accidents as a result of a third party's negligence then you may be entitled to compensation.

Are you normally insured?

You may think that some of these incidents are covered by insurance, for example road traffic accidents, but sometimes this is not the case and you may need to make a separate claim for personal injury, provided you were not at fault.

Requirements of a claim

Under UK legislation, if you want to bring a claim for compensation following bad accidents then you must do so within three years of the incident, unless you are representing a child in which case the claim must be made before their 21st birthday.

The calculation of damages is broken down into two categories; those which can easily be given a monetary value, such as loss of income, pension and medical expenses, and those which will require a further degree of assessment, such as pain and suffering, change to lifestyle and permanent disability.

Compensatory amounts

The amount of compensation that will be awarded is different in each case as an individual's personal circumstances must also be taken into consideration.

The final figure for compensation in bad accidents will be negotiated between the solicitors representing each party, unless they fail to reach an agreement, in which case it will be necessary for the case to go to court. Therefore you should appoint a solicitor capable of handling this scenario.
