What are workplace accidents?

A very common enquiry we receive at Contact Law is whether you can claim compensation for a workplace accident. The most common cases concern workers in:

  • Automobile factories
  • Construction

  • Repairs
  • Manufacturing

However, many different types of workers suffer workplace accidents across the UK. A workplace accident occurs when an employee suffers an accident or injury during working hours. The accident must have occurred as a result of the nature of their work and not be accompanied by any third party intention of causing harm.

Compensation may be claimed for an injury suffered whilst working, or as a result of your work, or if you developed some kind of occupational diseases as a consequence of your work.

To be considered as a work accident, and consequently be subject of compensation, the case must meet the following criteria:

  • The worker suffered an injury, physical or mental illness
  • It is a regular employee under an employment contract, self-employed or a working partner of a corporation
  • The accident is a result of the nature of the work

As a case handler, I would strongly recommend that you gather all the relevant documentation of the case. This includes witnesses and any other evidence that would facilitate a positive outcome of the dispute.

You need to pay a lot of attention to the deadlines for filing a claim.

  • For criminal actions, the deadline is 3 years
  • For a civil action you have to bring a claim within a year after you suffered the accident or started experiencing symptoms
