Can you be compensated for a back injury?


The back, in particular the spine, is a vital part of the body and any injury can lead to severe pain and discomfort. A back injury is a common result of most types of accident, including road traffic accidents, slips, trips and falls, sports injuries or any other kind of sudden impact, and these normally account for acute back pain. Unfortunately, injuries and traumatic events which can lead to a back injury are part of everyday life, but, if it has occurred due to another party’s negligence then you could be entitled to compensation for your personal injury.

The nerves in the back, and in particular the spinal column, carry nearly all the electrical signals necessary for sensation and to control the movement of the rest of the body. If these nerves are damaged then there is a significant chance that you will receive a large amount of compensation. All you need to establish is that the protagonist owed you a duty of care and that they breached that duty through their negligence. An example of this is the employer and employee relationship. Employers have particular duties to try and reduce the risk of their employees suffering any type of injury - including a back injury - caused by faulty equipment, poor training or manual handling activities. Once this duty and breach has been established, and loss has also been proved, your personal-injury solicitor will take care of the paperwork and provided the claim is brought within three years of the accident you should be entitled to a payout.

Remember, any compensation is not to be viewed as a reward. It is designed to try to put the claimant in the position they would have been in had the accident never occurred, and so levels of compensation are adjusted according to the severity of the injury.
