Accidents happen

The vast majority of accidents resulting in compensation claims take place on the road, involving:

Using an accident management company

If you have been in an accident which concerns your vehicle it will be in your best interests to contact a company that deals with accident management. An accident management company, such as an insurance company, will be able to provide you with a replacement vehicle as well as organise repairs. They will also help you:

  • Claim for any injuries you have sustained
  • Claim any loss of value to your vehicle (provided you have included this in your contributions to them)

An accident management company is there to help you save time and potentially money after you have been involved in a collision. The accident management company will in most cases liaise with your insurance company about repairs or a replacement vehicle.

Using an accident management company means that in most cases you won’t have to wait for your insurance company to process your claim, as the accident management company can often handle this for you, with the costs in most cases being met by your insurers.

If your insurer refuses to pay for the costs of using an accident management company, you may have grounds to recover the costs from them. Basically, if you have been involved in an accident which was not your fault, regardless of your own vehicle insurance, you should be able to get a replacement car through an accident management company and forward the bill to the insurance company of the at-fault driver.

If a dispute arises, you should speak to a solicitor who is experienced with such matters.

Making an accident claim is not a straightforward process, as in many situations it will be unclear as to whose fault the accident was. A claim cannot be successfully made unless an individual can be proved to be legally at fault and negligent.

Negligence is a certain type of conduct that is culpable because it does not meet the required standard of care that is expected of a reasonable person to protect another individual.

If you are faced with a situation in which you have had to take the assistance of an accident management company, it is highly beneficial if you can provide photographic evidence of the accident as well as the injuries sustained.

This will put the company in a better position to assist you with making a claim for compensation. The compensation awarded to you will be made keeping your injuries and loss in mind.
