Leasehold valuation tribunal

 

If you rent a residential property from a landlord they will often make changes to your lease and also carry out a review of your rent - usually on an annual basis.

If you feel that your landlord is not acting within the current property laws, you may have the option to use a Leasehold Valuation Tribunal to rule about your dispute.

Services offered

The Tribunal offers you a number of services that include:

  • Deciding what you should pay to your landlord if you want to buy (enfranchise) your current lease on your property
  • Resolving disputes under the Urban Development Act 1993 or the leasehold reform regulations
  • Deciding who pays for any damage to the property

How it works

The Leasehold Valuation Tribunal works closely with your local county court. In fact your local Rent Assessment Panel may well refer your case to the county court initially, but the judge may decide that your case would be better dealt with by a tribunal.

Both the Tribunal and the County Court are in part funded by the fees paid by those who use them. How much you need to pay will depend on the amount you are disputing. This is because the more money is involved, the more complicated the case is likely to be.
However, the fees are generally nominal and at present are not more than £350. Current fees are available online.

In most cases your dispute will come before a court. You and your landlord will be sent details of your court dates by the clerk of the Leasehold Valuation Tribunal. It is vitally important that you fully understand property law as it relates to leasehold valuations.
